You may sell first and notify within ten days

Every manufacturer and importer must provide Health Canada with a cosmetic notification at the latest ten days after they first sell the product, and a person must not sell it after that ten-day period if the notification has not been provided.

Canada and the European Union sit on opposite sides of the same decision, one taking the filing before the first sale and the other after it, so a launch calendar built for either market is wrong for the other by exactly the length of the filing.

Exceptions and limits

  • ThresholdThe filing wants concentrations, not just a list

The notification must carry each ingredient by INCI name with either its exact concentration or one of thirteen declared concentration bands, which is a materially deeper disclosure than the ordered ingredient list a pack carries.

The claim above holds only on one side of this boundary. Confidence 90 of 100.

Wrong if Paragraph 30(2)(d) is amended to drop the concentration or concentration-range requirement, or the banded table is removed from section 30.

    (d) a list of the cosmetic’s ingredients, according to their INCI name — or, in the absence of such a name, their chemical name — and, for each ingredient, either its exact concentration or the concentration range that includes the concentration of that ingredient

Constraint

Held since August 5, 2026A rule, law or policy that limits what you may do or say. The earliest date we are willing to say this held. It may well have been true before that; we do not backdate a record past the evidence we have read. Supported, version 1.

This entry is wrong if

Section 30(1) is amended to require notification before first sale, or the ten-day period is changed, or section 15.3(1) is repealed.

Written before the record was published, not after. If you can show this, send it to hello@tryorbt.com and the correction goes on the record with the entry.

  2. Tier Aregulation

Department of Justice Canada (Justice Laws Website): Cosmetic Regulations, C.R.C., c. 869

15.3 (1) A person must not sell a cosmetic after the 10-day period beginning on the day on which the manufacturer or importer first sells that cosmetic if the Minister has not been provided with the documents required under subsection 30(1).

The deadline would otherwise read as advisory. This is the provision that turns a missed filing into a prohibition on further sale.
