Safety has to be provable without animal data

Canada prohibits selling a cosmetic unless its safety can be established without relying on data derived from a test conducted on an animal that could cause pain, suffering or injury, and separately prohibits conducting such a test to meet a cosmetic safety requirement under Canadian law or that of a foreign state.

The second half is the one that travels: a test run abroad to satisfy another country’s cosmetic safety regime is itself prohibited conduct here, so an overseas filing strategy is not neutral in Canada.

Exceptions and limits

  • ExceptionSix carve-outs keep a lot of existing data usable

The prohibition does not apply where the data was published by the Government of Canada, is publicly available and was not sponsored by the seller, was generated to meet a non-cosmetic legal requirement in Canada or abroad for a substance also used in a non-cosmetic product, predates the section coming into force, or relates to a cosmetic already sold in Canada before that day.

The claim above does not hold for this subset. Confidence 90 of 100.

Wrong if Subsection 16.1(2) is repealed or narrowed so that pre-commencement data or publicly available third-party data can no longer be relied on.

    (2) The prohibition in subsection (1) does not apply if (a) the Government of Canada has published the data in a scientific journal or on a Government of Canada website; (b) the data is publicly available and is derived from a test that was not sponsored by or conducted by or on behalf of a person who manufactures, imports or sells the cosmetic; … (d) the data is derived from a test that was conducted before the day on which this section comes into force; (e) the cosmetic was sold in Canada at any time before the day on which this section comes into force
