Cross into therapeutic goods and this standard stops

The Consumer Goods (Cosmetics) Information Standard 2020 does not apply to therapeutic goods within the meaning of the Therapeutic Goods Act 1989, and it applies to cosmetic products manufactured in or imported into Australia after the end of 180 days from its commencement.

The labelling rules a brand is working to are decided by a classification it does not control, so a claim added late in the artwork cycle can move the product into a different Act with a different regulator and a registration step that was never in the plan.

Constraint

Held since May 23, 2021A rule, law or policy that limits what you may do or say. The earliest date we are willing to say this held. It may well have been true before that; we do not backdate a record past the evidence we have read. Supported, version 1.

This entry is wrong if

Subsection 5(2) of the Information Standard is amended so that therapeutic goods are also subject to it, or the Therapeutic Goods Act 1989 ceases to define therapeutic goods separately from cosmetics.

Written before the record was published, not after. If you can show this, send it to hello@tryorbt.com and the correction goes on the record with the entry.

  2. Tier Aregulation

Office of Parliamentary Counsel (Federal Register of Legislation): Consumer Goods (Cosmetics) Information Standard 2020 (F2020L01469)

    (1) This instrument applies to cosmetic products: (a) manufactured in Australia and intended to be used in Australia; or (b) imported into Australia; if the products are manufactured (whether in or outside Australia) after the end of 180 days after the commencement of this instrument.

The import limb matters more than the manufacture limb for anything crossing a border: the obligation attaches on import, not on establishment in Australia.

Initial entry from primary legislation, read 2026-08-06. Titles resolved through the Federal Register of Legislation's catalogue API, which reports in-force status; the text comes from the Register's unpacked EPUB at the dated version path, because the document pages are a JavaScript shell and the `/latest/` alias silently serves part one of any multi-part Act.
